1Who sells

The seller is The Genesys S.r.l. (sole shareholder), Via Felice Casati 32, 20124 Milano (MI), Italy — VAT and tax code 13675650967, registered with the Companies Register of Milano Monza Brianza Lodi under the same number, REA MI-2737451, share capital € 10,000.00 fully paid. 2What these terms cover

These terms govern the purchase of the hardware kits sold on www.thegenesys.tech — Hermes HUB on its own, or together with a 3D printer — by a consumer, that is someone buying for purposes outside their trade or profession. The use of the app, the files and G-Coins is governed by the Terms of Service published on the site.

3Products and prices

• The main features of each kit are described on its page, together with the specifications stated by the printer’s manufacturer.
• Prices are in euro and include VAT.
• The shipping cost, currently free, is always shown in the order summary before you pay. The total you pay is the one in the summary.

4How the contract is made

• You can order with your Genesys account or without one: then we only need the email to send the confirmation to, and if you like you create the account with the order. You give the shipping address and pay.
• By pressing the payment button you place an order with an obligation to pay.
• The contract is made when the payment is authorised. We send you the order confirmation by email, with the order number; if you have an account, the order stays visible there.

5Payment

You can pay by credit or debit card, Apple Pay or Google Pay. Payments are handled by Stripe: card details never pass through our servers. The amount is charged when you order.

6Delivery

• We ship within Italy and to the other European Union countries, by courier with a tracking number. The cost for your country is the one in the order summary.
• The kit normally leaves within 48 working hours of the payment being confirmed, and we write to you when it is on its way. In any case delivery takes place within 30 days of the order, as the Italian Consumer Code requires.
• The risk of loss or damage passes to you when you receive the parcel.

7Right of withdrawal

You have 14 days to withdraw from the contract without giving any reason. The period starts on the day you, or a person you name other than the courier, receive the kit.

How to withdraw. Send us a clear statement before the period ends: an email to dev@thegenesys.tech with the order number is enough. You may use the form below, but you don’t have to.

The refund. We refund all payments received from you, including standard delivery costs, within 14 days of the day we receive your notice, using the same means of payment you used and at no cost to you. We may withhold the refund until we have received the kit back, or until you have shown that you sent it, whichever is earlier.

Sending it back. Return the kit within 14 days of your notice of withdrawal, to the address we give you in our reply. The direct cost of returning the kit is yours. You are only liable for any loss of value resulting from handling other than what is necessary to establish its nature, characteristics and functioning.

8Withdrawal form (optional)

9Legal guarantee of conformity

• Every kit is covered by the legal guarantee of conformity under the Italian Consumer Code (articles 128 and following): we are liable for defects that appear within 2 years of delivery.
• If the defect appears within one year of delivery, it is presumed to have existed at delivery, unless proven otherwise.
• You are entitled to have the goods brought into conformity — repair or replacement, free of charge — or, where the law provides, to a price reduction or to terminate the contract.
• To use the guarantee, write to us with the order number and a description of the defect: the law asks you to report it within two months of discovering it.
• Any manufacturer’s guarantee is in addition to the legal one and does not replace it.

10Support and complaints

For any problem with an order write to dev@thegenesys.tech, giving the order number you find in the confirmation.

11Governing law and disputes

• The contract is governed by Italian law. The protections that the law of your country of residence does not allow to be waived remain in place.
• Disputes fall under the court of the place where you live or are domiciled.
• You may also turn to an alternative dispute resolution (ADR) body provided for by the Italian Consumer Code.
• Your order is governed by the terms published on this page at the moment you place it.
